The island of Jersey is just 45 square miles in size but home to over 95,000 permanent residents. Located 100 miles south of England and just 14 miles from the French coast, it is the southernmost island of the British Isles.
The largest of the Channel Islands, Jersey has a unique relationship with Britain. It is not part of the United Kingdom or the European Union although the UK is responsible for the defence of Jersey. An international finance centre
Jersey has a significant financial services industry with around 40 per cent of the country’s GVA coming from this sector.
The finance industry on Jersey has only properly existed in Jersey since 1962, when a law that had capped interest rates at 5 per cent was abolished. In subsequent years many financial institutions were drawn to the Island by its stable government, proximity to both the UK and continental Europe and low taxes. Jersey is now an international financial centre, with over 33,000 registered companies.
The Jersey Financial Services Commission is responsible for the regulation and supervision of the financial services industry on the island including banking, insurance business, trust and company service providers and general insurance mediation business.
From November 2015 the Channel Islands Financial Ombudsman (CIFO) will have the power to investigate and resolve complaints about financial services provided in/from Jersey, Guernsey, Alderney and Sark.
Jersey’s legal system
Jersey’s legal system is bigger than neighbouring Guernsey, partly due to the Bailiwick’s larger financial services industry.
Each of the Channel Islands has its own legal system and the laws are based on concepts from both English and French-Normal law. Because Jersey is not part of the European Union, it is not subject to EU legislation.
Both local and foreign lawyers can advise on trusts, finance and corporate law but only locally qualified Jersey lawyers are allowed to appear in front of the courts.
